  1. Definitions

    • "Platform" refers to the Bhuk.me website and related services.
    • "Professional" refers to individuals or businesses offering services via the platform.
    • "Customer" refers to individuals booking services via the platform.
    • "User" refers to both Professionals and Customers.
    • "Service" refers to the specific task or work provided by a Professional and booked by a Customer.
    • "Booking" refers to the agreement between a Professional and a Customer for a specific Service, the scheduling and payment of services via the platform.
    • "Commission" refers to the 10% fee charged by the Platform for each successful booking.
  2. User Eligibility and Account Creation

    • To use the Platform as a Professional, you must be legally able to offer services in South Africa.
    • Professionals must create an account using a valid email address, password, and a unique handler.
    • Customers are not required to create an account but must provide accurate personal information when making a booking.
    • You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
  3. Service Description

    Bhuk.me is an intermediary platform that connects customers with professionals offering various services. The platform allows customers to browse and book services, while professionals manage their availability and services. Bookings are confirmed upon successful payment through our third-party payment processor, Paystack.

  4. Booking Process

    Customers can select services from a professional's profile, choose the date and time, and pay for the services via Paystack. Once payment is received, both parties are notified via WhatsApp.

  5. Pricing and Payment Terms

    • Professionals set their own prices for services offered through the Platform.
    • The platform charges professionals a 10% commission on all completed bookings.
    • All payments are processed in South African Rand (ZAR) through Paystack.
    • The Platform will deduct its 10% commission before releasing funds to the Professional.
    • Professionals are paid only once the service has been rendered and marked as "fulfilled" using a unique PIN provided to the customer during booking. The customer is responsible for keeping the PIN safe and sharing it with the professional after the service has been completed.
    • Professionals are responsible for ensuring they comply with tax obligations under South African law.
  6. Cancellation and Refund Policy

    • Professionals can reschedule or cancel a booking through the platform.
    • If a booking is cancelled, the customer is entitled to a full refund.
    • If rescheduled, the customer has the right to accept or reject the new dates proposed by the professional.
  7. User Obligations

    Professional Obligations:

    • Provide accurate information about services and availability
    • Maintain a high standard of service quality
    • Communicate promptly with Customers
    • Comply with all applicable laws and regulations
    • Mark services as fulfilled only upon completion

    Customer Obligations:

    • Provide accurate personal information when booking
    • Attend scheduled appointments or provide timely notice of cancellation
    • Treat Professionals and their property with respect
    • Pay for services as agreed
    • Provide the completion PIN to Professionals only after satisfactory service delivery
  8. Platform's Role and Limitations of Liability

    • The Platform acts solely as an intermediary between Professionals and Customers.
    • We do not endorse, guarantee, or assume responsibility for any service provided by Professionals.
    • We are not responsible for the quality, safety, or legality of services provided.
    • To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Platform and services booked through it.
  9. Intellectual Property Rights

    • The Platform and its original content, features, and functionality are owned by Bhuk.me and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
    • Users may not copy, modify, create derivative works, publicly display, perform, or distribute any content from the Platform without prior written consent from Bhuk.me.
  10. Dispute Resolution

    • Users agree to attempt to resolve any disputes directly with each other in good faith.
    • If a resolution cannot be reached, users may request mediation through the Platform's support team.
    • Any legal action related to these Terms and Conditions or the Platform shall be filed in the appropriate court in South Africa.
  11. Termination of Services

    • We reserve the right to terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions.
    • Upon termination, your right to use the Platform will immediately cease.
  12. Governing Law and Jurisdiction

    • These Terms and Conditions shall be governed by and construed in accordance with the laws of South Africa.
    • Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of South Africa.
  13. Updates to Terms and Conditions

    • We reserve the right to update these Terms and Conditions at any time.
    • Users will be notified of any significant changes via email or WhatsApp.
    • Continued use of the platform indicates acceptance of the updated terms.
